1948 Case with Luigi Paiano
Re: 1948 Case with Luigi Paiano
How did you get copies of Italian birth certificates? Did you have the law firm translate your documents or someone in the US? I am gathering my documents now, just need my great grandparents birth certificates from Carlantino, Italy. Thanks.
Re: 1948 Case with Luigi Paiano
Hi All,
I'm American and did it through Luigi Paiano for my extended family, 11 of us in total. Luigi is very sharp and he won't take the case if he doesn't think it will win. I can vouch for his reliability, honesty, and knowledge of the process! He's also a very professional and friendly man. That said, it took me about 4 years to get all the documentation together (we are military brats born all over). Also, we had strange anomalies to contend with such as my mother deciding she wanted to be one year younger when she was a teenager so all the birth dates were off by a year from her actual birth date. Also, I had Luigi do a vital records search for her birth certificate in the little town in Italy and she had a completely different name. Because of this I had to have all our US birth certificates amended. In one case, for one of my sisters, after the case won and he sent all the documents to the comune, they registered her with my mother's middle names because TexARSE had such a cryptic method for amending the birth certificates so she has a different name now in Italy. Anyway, it's been two years since we were finally granted citizenship, but we are all just now starting to register in the AIRE with the consulate. I did it first so I could tell everyone what to do since they all wait for me to do that with this process lol. So I registered with all the docs they ask for - my advice in FAST IT is to right click on Chrome if you use it and choose Translate to English. Anyway, I am awaiting the response from the comune and then once this blasted pandemic is over, will set up the appointment to order my passport, unless they find a way to do it remotely. I haven't seen that on the site yet.
So, if you have any questions I'd be happy to help. I see unanswered questions from people and feel bad, when I did it, everyone here was super responsive. Maybe this pandemic has everyone preoccupied. Seems to me, now is a good time to get all your paperwork done. Good luck in all your efforts everyone!

Re: 1948 Case with Luigi Paiano
I'm using ICA, they sent me a form in Italian that I had to sign to request my relatives Birth Certificate from the respected Comune. They then go to the Comune and get the official copy. It has to be a certified copy, so the scans from family search are only usable for speeding up the process which is what I provided prior.
I visited another Comune over a year ago, and had a local translator request copies and they were not certified or usable for the process either as the book would not even fit on the copier they were using. Realized that process was going to be painful, even sent a form to another Comune for records in Italian requesting the docs, but never heard anything back, one email bounced, my contact in Italy was of no help, so I decided to go with ICA since my case will be a 1948 as well.

FaSTIT was recently launched in English, Spanish and Portuguese. However, it nows format dates according to your system settings, so they are no longer in Italian format only, which can get confusing.
Re: 1948 Case with Luigi Paiano
After 6 years in the process my passport finally arrived today!! Luigi will make it happen! I do have one additional question. A coworker of mine is looking into the process for himself now and his line is to his father then grandparents. He has no records of his grandfather who died when his father was very young so he is unsure of going that route. The documentation on his grandmother says her parents became citizens when she was about 15 and the document (a poorly Xeroxed copy of the original) seems to be some sort of naturalization for the whole family but he is unsure. In this case, would his grandmother have become naturalized at the same time as her parents since she was still a minor?

Hi everyone!
After the mandated hearing rescheduling due to Covid, my family will have the second hearing for both cases heard in May. Fingers crossed.
Alexr119, it sounds to me that your coworker must speak with Luigi directly about that one as there are some challenges and court rullings issued regarding Naturalization and minors lossing their citizenship "by default" as a result. He will tell you for sure.
Ciao!

Re: 1948 Case with Luigi Paiano
Hi all, my extended family is looking to pursue a 1948 case through my GGM, since my GF was naturalized before he had my M. From what I've seen the case looks relatively straight-forward. We are looking at three attorney options - Luigi Paiano, Arturo Grasso, and ItalMe (Ray Rapallo). However, I'm a little confused because ItalMe is quoting us nearly $20K. They have great reviews on Google and are based in the US and maybe that is why they are able to charge so much to unsuspecting Americans. I really am drawn to Arturro based on our original correspondence but at this point just trying to make a decision on moving forward.
Has anyone heard of / used ItalMe and what was the experience?

Re: 1948 Case with Luigi Paiano - Australia
G'day all,
Short version is I have obtained all birth/death/marriage certificates for my family dating back to 1703.
I have also obtained Australian Naturalization certificates.
Next step is to have the Apostilled and translated from English to Italian.
I have a quote from Avv Paola Caputi and have emailed Avv Luigi Paiano.
Has anyone from Australia used him?
How much does he charge if most of the work has already been completed?
Thanks all, Paul

Re: 1948 Case with Luigi Paiano
G'day all, I have contacted Luigi PAIANO and provided significant and detailed information to support my application under the rule of 1948. Grandmother was born in Italy, father was born in Italy in 1947, grandmother was still an Italian citizen when I was born. Very simple stuff.
I received a 2 line reply saying I can't apply under the rule of 1948 and have to live in Italy for 3 years.
This is not the advice I have received from another Italian lawyer.
I'm very certain he has misunderstood my email to him. In fact I'm not even sure it was actually him who replied.
Has anyone experienced such a reply?

Re: 1948 Case with Luigi Paiano
Odds are he is swamped with people, mainly Americans trying to get citizenship due to the state of the nation or prior state however you look at it. It took 6 months to retain ICA due to the influx of people trying to obtain citizenship. I never contacted Paiano, but a one liner would not warrant me to move forward or transfer funds for a retainer.Snooper wrote: ↑18 Mar 2021, 23:04 G'day all, I have contacted Luigi PAIANO and provided significant and detailed information to support my application under the rule of 1948. Re: 1948 Case with Luigi Paiano
I've heard that Paiano only wants "slam dunk" cases. He's the pre-eminent attorney for 1948 cases so he can afford to choose his clients.Snooper wrote: ↑18 Mar 2021, 23:04 G'day all, I have contacted Luigi PAIANO and provided significant and detailed information to support my application under the rule of 1948. Your father was born in Italy? Then your grandmother is irrelevant. When did your father naturalize?

Re: 1948 Case with Luigi Paiano
I have sent several large and complex cases to Paiano and found him to be willing to take those cases without record amendments that other lawyers would require. Yes, he may decline cases that he knows he can lose, but he is also willing to do by himself the job of dealing with discrepancies in documents. So far every case had a favorable sentence.qualdom wrote: ↑23 Mar 2021, 03:18I've heard that Paiano only wants "slam dunk" cases. The trial was on December 7th and I was notified on the positive result on December 30th. I was told that the appellate period was 90 business days, which is different from other cases on this forum, which were 1 month or 6 months. The 90 days period ended yesterday, but I was told by my lawyer that "due to the pandemic, the judicial bureaucratic procedures are still delayed".
Has anyone had their appellate period end lately? So I can know more or less of how much delay to expect.
Thanks!

Does not seem to be abnormal. ICA quoted me 2-3 years, but the pandemic might add another year or two with all the records still in flux, just not in Italy but the USA.canzq wrote: ↑22 Apr 2021, 20:51 Hello everyone

Yea, definitely, I was told there will be delays when the pandemic started. I'm hoping to be done this year since I'm already in the last steps of the process. Btw I'm with Castellari and I'm from Chile.afecad wrote: ↑24 Apr 2021, 02:23Does not seem to be abnormal.
