This will likely be the end of the road for a significant percentage of people seeking citizenship through their great-grandparents and beyond, including myself. Still, it does note that cases already legally submitted to the courts will be reviewed. Grandfathered perhaps??
I'm waiting for a response from ICA to confirm, as I have a court date set for October.

I am really holding out for ICA to give some updates on this. My case was submitted in February and a judge assigned to my case at the end of February. My case is being heard by Filippo Palumbo in Potenza. My question is I am hearing that if your case is already filed and pending review you are safe. IF you have yet to file, you could have an issue. Thoughts.....

I haven't heard back from ICA yet about this. I have been on Reddit because it has a significant following and many discussions on the topic.
One is that the decree is not retroactive, so hopefully, this means that those who have cases filed in court before the decree date will be grandfathered. What this means post-decision regarding the consulate interview is a big question.
I also do not know what it means for a 1948 case if, for some reason, there is an appeal to a rejection.

I will check that out! @afecad - I was told that this may not have as much affect on the 1948 cases because they are judicial processes. I am on pins and needles. My case has already been filed in the court and a judge assigned so hopefully we are in the clear. Just a real nightmare!!!

I had assumed that changes to Italian citizenship law were likely but I did not expect them to occur so swiftly!
I am sure that everyone who initiated the process will be protected. However, some attorneys are encouraging people to keep filing petitions in the anticipation that these changes will be nullified - umm I think they might be whistling past the graveyard. I feel that these changes have a lot of popular support and are in line with the EU's vision of citizenship for member countries. My spouse is from another European country and they are also restricting ancestry-based citizenship and expanding citizenship for immigrants who reside in the country.

wow...is that right! They let go of 200 staff members? Maybe that is the reason I have not heard anything back! I assume based on the video posted some of us are safe due to the cases being filed before the new decree became active but I am hoping to get something a little more personal from our attorney.

This is a real mess! I guess I have two questions. Although my case is filed, Marco is my representative for the court hearing—will he continue to show up for that? I assume my documents are all safe and filed with the court as part of that process, so I shouldn’t worry about my documents being lost or anything like that, correct?
Assuming I am approved through my court case, ICA was supposed to also ensure that the documents were transferred to the commune and registered with AIRE. With everything going on, it would be nice to hear something official from ICA.

I don't think you have anything to worry about regarding the court procedure. The reddit forum referenced by afecad mentions that Marco seems utterly defeated regarding the changes. This is in contrast to the some other of the other attorneys who are urging clients to keep filing cases as they anticipate this decree will be successfully challenged in court.
Marco can probably afford to be more truthful in this regard, as he was enterprising enough to create citizenship companies for Croatia, Ireland, etc. The other attorneys are probably more dependent on Italian jus sanguinis and they are not being sincere about the future of these cases.

Thanks so much for the response! I received an email this morning from the legal team at ICA. I know everyone 's situation is different but it appears that my case is still moving forward. The legal team has all my documents in their possession and the court has not requested the originals, only scanned copies. The judge has already been assigned to my case just no news on the hearing date. For anyone else that has not filed, I would personally continue to gather your documents in the states. There may be a way to challenge all this at some point and you just want to be ready when/if that time presents itself.

If all goes as planned, this might be done in late 2025 or early 2026.
ICA stated it will be approx. 60 days after the court date, then AIRE registration, etc. Consulate appt for Passport.
I should have done this 20 years ago, but I waited.

Around 2002, I started research but it was not easy to find all documentation since much was not online. I wasn't aware my GGF officially naturalized till I started with ICA but there was some presumption he did.
I was also not clear on my options since I knew my GGGPs did not naturalize. One remained in Italy and the rest came over to the US.
