Current Italian birth laws...
Does anyone know if a child of USA citizen parents is currently born in Italy, can that child become a citizen of Italy--and then its parents?
Re: Current Italian birth laws...
Not 100% sure of this, but I think that if a child is born in Italy of foreign parents, but uninterruptedly lives there from birth, then he could qualify to become an Italian citizen. Don't know about the parents though.
Re: Current Italian birth laws...
If he is born there and lives there, when he reaches his majority, he can request Italian citizenship. This applies only to him, not to his parents. If he returns to the US (or elsewhere) to live, he is no longer eligible. Italian citizenship laws are based on jus sanguinis (birth to an Italian citizen) not jus soli (birth on the soil).
Re: Current Italian birth laws...
actually I just found the following to further explain the above:
# a child is born on Italian soil, on the condition that the child’s parents:
# are unknown or Stateless; or
# are foreigners who, pursuant to their country’s legislation, do not pass on their own citizenship to their child;
# in cases in which a child has been found abandoned on Italian soil;
# in cases of adoption.
