Probono lawyer for 1948 case

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Probono lawyer for 1948 case

Post by Rhonda Z »

Hi everyone.

Where could I possibly find an immigration lawyer who could assist me pro bono on my 1948 case?

Good evening, @Rhonda Z -

Navigating a 1948 Italian citizenship case can be particularly challenging, especially given the recent legal developments in Italy. These cases often require filing a lawsuit in the Italian courts due to the complexities involved. Getting someone to do this pro bono is highly unlikely. You will have to retain an attorney, assisting with certifying and translating documents, filing your case, paying legal fees, etc. etc.

Additionally, the Italian Constitutional Court (Corte Costituzionale) is scheduled to hear a significant case that could impact citizenship by descent applications, including those affected by the "minor issue." Staying informed about the outcomes of such cases is crucial, as they may influence the interpretation and application of citizenship laws.

If you have not started this process already and your case is not already filed as of March 27th, I would do what you can to get all your documents, but wait to see what happens in June so you are not wasting any money on this process before you know IF you still qualify.

That would be my recommendation at this time.

I hope that helps!

If you didn't ask recognition of Italian citizenship with the old law (or at least began the process before 28 March) now with the new law, italian citizenship is limited to two generations after emigration.
That is you are Italian if the person born in Italy was your grand_father or g-mother and after emigration didn't ask other citizenship before your birth.
Of course, as it was with the old
law, your father or mother born abroad, should not have renounced to the Italian citizenship.
There are special rules concerning minors.
