Loss of Italian nationality by minors

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Loss of Italian nationality by minors

Post by chloeari »

Good afternoon,

I have a bit of an atypical situation:

My mother was born to an Italian mother and and Egyptian father in 1958. Due to the operation of Jus Soli and Jus Sanguinis, she would have been Egyptian-Italian. She emigrated with her parents to Canada and naturalized with her parents in 1970.

The law #555 art. 12 states that the non-emancipated child who lives with their father who loses his citizenship, loses theirs as well (or the mother if the father is dead). In this case, the father was alive and well, but was never Italian to begin with. Since her Italian nationality was dependent on her mother, and no provision in the law dictates says otherwise, is her Italian nationality still intact?

It really doesn’t matter that it was the mother and not the father who was an Italian citizen. What matters is that she was naturalized, and naturalization caused the loss of Italian citizenship. Sorry.
